1. Introduction & scope
1.1 These Terms of Service (“Terms”) govern your use of the Namibia Travel Wheels website and services (“Platform”). By using the Platform you agree to these Terms. If you book a rental through the Platform you also agree that the applicable rental company’s terms will govern the actual vehicle hire.
1.2 Travel Wheels Namibia operates only as a matchmaking platform connecting Customers (renters) with independent Car Rental Companies (Suppliers). Namibia Travel Wheels does not own, supply, maintain or insure vehicles and is not a party to the vehicle rental contract between you and the Supplier.
2. Booking flow & deposits
2.1 When you submit a rental request, Travel Wheels Namibia forwards your request to pre-approved Suppliers. Suppliers may provide quotes directly to you through the form via email.
2.2 If you select a quote and click Confirm Quote, you will be asked to pay an 8% non-refundable deposit of the quoted rental price. The deposit secures the booking and is revenue for Namibia Travel Wheels. The balance and any additional charges are payable to the Supplier under their rental agreement.
2.3 Payment is processed via the Platform’s payment processor ([DPO Payments Namibia]). You authorize Travel Wheels Namibia to charge the deposit to the payment method you provide.
3. Relationship & responsibilities
3.1 Travel Wheels Namibia acts only as an agent/intermediary facilitating communication and payments between Customers and Suppliers. Each Supplier is an independent contracting party and is solely responsible for vehicle availability, roadworthiness, insurance, and the provision of the vehicle.
3.2 Customers must accept and comply with the Supplier’s rental agreement at the time of vehicle collection. Any dispute regarding vehicle condition, insurance, damages, or Supplier conduct must be raised with the Supplier in the first instance; Travel Wheels Namibia will use reasonable efforts to assist.
4. User obligations
4.1 Customers must supply accurate, complete and truthful information when creating rental requests and during the booking process.
4.2 Customers are responsible for ensuring that all drivers meet the Supplier’s age, licence and identification requirements.
4.3 Misuse of the Platform (fraud, providing false identity, attempting to avoid Supplier terms) may result in cancellation and forfeiture of deposit.
5. Payment, refunds & cancellations
5.1 The 8% deposit is non-refundable except where a Supplier cancels a confirmed booking (see Cancellation Policy). Any refunds will be processed via the original payment method less any applicable fees.
5.2 Namibia Travel Wheels may withhold or delay refunds where required to investigate fraud or disputes.
6. Liability & disclaimers
6.1 Namibia Travel Wheels makes reasonable efforts to verify Suppliers but provides no warranty regarding Supplier performance, vehicle quality, legality of use, or accuracy of quotes. Use of the Platform is at your own risk.
6.2 To the maximum extent permitted by law, Namibia Travel Wheels’ total liability to any Customer in connection with the Platform (whether in contract, delict, or otherwise) is limited to the amount of the deposit paid for the booking. Namibia Travel Wheels is not liable for indirect, incidental, special or consequential losses (including lost profits, travel disruption, or personal injury) arising from the acts or omissions of Suppliers.
7. Indemnity
You agree to indemnify and hold Travel Wheels Namibia and its officers, employees and agents harmless from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, fraudulent use of the Platform, or negligent acts.
8. Intellectual property
All Platform content is protected by copyright and other IP rights. You may not reproduce or use Platform content except to the extent necessary to use our services.
9. Privacy & data
Our Privacy Policy describes how we collect and use personal data. By using the Platform you consent to the collection and transfer of your personal information as described in the Privacy Policy.
10. Governing law & disputes
These Terms are governed by the laws of the Republic of Namibia. Any dispute arising from these Terms will be subject to the non-exclusive jurisdiction of Namibian courts.
11. Changes to Terms
Namibia Travel Wheels may update these Terms. We will notify users of material changes; continued use after notice constitutes acceptance.
